Freedom of Expression

The right to freedom of expression is a right that has been guaranteed by various regulations in Indonesia. This right has been increasingly gaining legal guarantee in both normative and practical terms after the 1998 reformation. In its development, freedom of expression has also encountered challenges since it has often come into contact with many interests. Thereby, various expressions have frequently faced intimidation, violence, and criminalisation.

Currently, the tendency of freedom of expression violations is increasingly alarming. ELSAM’s latest survey has showed that the situation of freedom of expression in general is not  fully in order. Various regulations that have been established at both local and national level have a tendency to contradict the right to freedom of expression as well.

Development of the internet increasingly expanding in Indonesia creates a new model of communication and interaction patterns among individuals. This situation also poses various threats to freedom of expression in the virtual world in which there are increasing imprisonment of individuals who express their attitudes and views through various internet channels; as well as government regulation and control over content by blocking, filtering; etc.

Responding to the situation, ELSAM advocates the implementation of the right to freedom of expression, both offline and online. The activity undertaken, among other things, is policy advocacy in order to ensure that established regulations do not violate the right to freedom of expression, including human rights-based internet governance advocacy. The other activities are case assistance, campaign, and knowledge production.

In advocating the freedom of expression on the internet, ELSAM has been affiliated with ID-CONFIG (a joint secretariat initiated by several Civil Society Organizations (CSOs) that have a concern for internet governance in Indonesia; ID-CONFIG will serve as a liaison among CSOs, as well as among CSOs and other stakeholders such as government, business groups, and academics to formulate main issues on internet governance).
