Salah satu perubahan yang paling signifikan dalam diskursus dan praktik hak asasi manusia belakangan ini adalah soal keterkaitan antara bisnis dan hak asasi manusia. Memang sekilas sangat susah menemukan hubungan antara bisnis dan perlindungan terhadap hak asasi manusia. Namun demikian, dewasa ini keterkaitan itu semakin disadari baik di tingkat nasional, regional, maupun internasional.
Peningkatan ekonomi dunia sejak tahun 1970-an telah mendatangkan efisiensi dan produktivitas yang semakin besar dan merangsang globalisasi di satu sisi, tetapi di sisi lain mendatangkan masalah berupa degradasi sosial dan kerusakan lingkungan hidup di negara-negara berkembang. 


Keprihatinan terhadap dampak negatif globalisasi ekonomi ini tidak hanya membersit dari para aktivis dan organisasi non-pemerintah yang bergerak dalam isu hak asasi manusia dan lingkungan, melainkan juga dari para pengambil keputusan dan pemimpin bisnis itu sendiri. Keadaan negatif itu dinilai telah merusak kepentingan bisnis itu sendiri dan pengembangan hidup manusia. 

Sistem hak asasi manusia didasarkan pada asumsi utama tentang kekuasaan negara sebagai penanggung jawab utama dan bergelut keras tentang bagaimana menangani aktor-aktor bukan negara (non-state actors) yang bisa melanggar hak-hak asasi manusia atau menghalangi pemenuhan hak-hak mereka.

Tanggung Jawab Bisnis terhadap Hak Asasi Manusia: Sebuah Pemetaan Singkat dalam Perspektif Norma Internasional  Oleh Eddie Sius Riyadi 

Abstract:  This article explains how human rights obligations will be applied to corporations. To elaborate the issue, this article will map the scope of human rights obligations in international law, standards, norms and pratices. Here I use the two important ethical principles which are ”do no harm principle” and ”affirmative duty”. The two-in-one principles is then related to three perspectives of corporations capacity in terms of human rights obligations, which are viewing corporations as main violator, aider and abettor, and as promoter and protector. This article will show that legal approach itself and alone is very limited to satisfy our thirst for human rights responsibility. Thus, I suggest to move beyond conventional approach which gave too much focus on violations to another and new approach, which is called ”responsibility approach”.

Landasan Teoretis bagi Tanggung Jawab Sosial Perusahaan: Dari Pemegang Saham (Shareholder) ke Pemangku Kepentingan (Stakeholder)  Oleh Eddie Sius Riyadi

Abstract: This article describes the theoretical basis of corporate social responsibility discourse and debate. It explains two views. The first view, classical view, sees the only motive of business is to gain the profit, consequently, the business obligation is only economic responsibility. This view then often called as ”shareholder perspective”. However, the second view sees the business obligations are not only economic enterprises, but also legal, ethical, and philantropical responsibilities. It means that the scope of business responsibility is not only aimed to the internal circumstance of corporations, but also and should be to other ”stakeholder”. This ”stakeholder perspective” is the focus of this article, which is then elaborated under the light of ethical principles, i.e.: do no harm and affirmative duty principles. Here I suggest that corporations have to hold the human rights obligations by first of all respect the ”do no harm principle”, and then ”affirmative duty” which is not a trade-off with the first principle. This article argues that if a corporation wants to survive, it by all means has to respect the ethical responsibility which in turn will bring benefit to it. But in the closing remark, I insist that the business respect to ethical responsibility is not only because of benefit strategy, but mainly because it has obligations as such as it is a member of society.
